We have previously published articles regarding the HWGIR and its impacts (Part I, Part II & Part III) on Hazardous Waste generators. A key facet of the rule is having the individual states adopt the rule. There has recently been an upswing in activity in regards to state adoption so we wanted to present you with this update:
Vermont – rule took effect 2/1/22
Texas – rule took effect 2/3/22
Oregon – rule took effect 1/1/22
Maryland – rule took effect 5/3/21
Tennessee – rule took effect 5/13/21
Delaware – rule took effect 1/21/21
Note that is important to realize that as explained in our previous posts, each state must adopt the more stringent parts of the rule; the states do have the option to adopt all or just portions of the less stringent parts of the rule. It is incumbent on each generator to understand how the rule is applied in the state in which they operate.
The rule is now in effect in 38 states plus the US Territories. States that have not adopted the rule are California, Montana, Minnesota, Nebraska, Kansas, Missouri, New York, Massachusetts, Rhode Island, Connecticut, New Hampshire and Maine. WTS will continue to monitor these states and report on any adoption activity accordingly.
